MEETING MINUTES

MARCH 22, 2005

 

Present:            ZBA Alternate James Hulen, ZBA Member Hillary Young

                        ZBA Member Raymond Johnson and ZBA Member Jonathan Cooper

CALL MEETING TO ORDER:

ZBA Member Jonathan Cooper called the meeting of the Zoning Board of Adjustments and Appeals to order at 5:43 P.M..

 

DISCUSSION/ACTION ZBA MINUTES OF FEBRUARY 21, 2005:

A motion was made by Hillary Young and seconded by James Hulen to approve the minutes of the Zoning Board of Adjustments and Appeals meeting held February 21, 2005 as presented.  Motion carried, all voting aye.

 

DISCUSSION/ACTION ZBA CASE NO. V050301:

A motion was made by Hillary Young and seconded by Raymond Johnson to approve the request made by Walter Northcutt/Beer Wells Real Estate for a variance to place a second off-site sign on property fronting I30 Service Rd., aka Shannon Rd, being further described as Lot 1-12, Block 219. The motion carried, all voting aye.

 

DISCUSSION/ACTION ZBA CASE NO. 050302:

A motion was made by Raymond Johnson and seconded by Hillary Young to deny the request made by Owner/Troy Coving for a Special Use Permit for property located at 735 College St., being further described as Lot 14, Block 56-2 to use the existing structure as a Rooming House.  The motion carried, all voting aye.  The board requested more information from Mr. Covington regarding his business plan and asked that Staff do some research in the surrounding cities to see how they handle rooming houses.  Mr. Covington could then resubmit his request to the Board.

 

DISCUSSION/ACTION ZBA CASE NO. V050303:

A motion was made by James Hulen and seconded by Raymond Johnson to approve the request made by Chris Childers for a variance to park a modular home in his back yard located at 1535 College St., being further described as Lots 9A & 10A, Block 222-1-2 for a 6 month variance because of his grandmother’s sickness.  There were several neighbors there to speak on Mr. Childers behalf.  They each stated that they did not have a problem with the structure being there and that they thought the six months was fair.  One neighbor brought two more responses with her to the meeting and gave them to the board.  Both responses were in favor of letting Mr. Childers keep the structure on his property.  Motion failed with Raymond Johnson, James Hulen and Jonathan Cooper voting aye and Hillary Young voting nay.  It states in the Operating Rules and Procedures of the Zoning Board of Adjustments that there must be at least four members present for a quorum and that “The concurring vote of four members of the ZBA shall be necessary to reverse any order”.  Mr. Vance told Mr. Childers that he would send out a letter to him regarding the structure and that he would probably have 30 days to move it.

With no other business before the Board, Jonathan Cooper adjourned the meeting at 7:00 P.M..
