MEETING MINUTES

September 19, 2006

 

 

Present:            ZBA Chairman Clayton McGraw, ZBA Vice Chairman Joel Sheffield,

                        ZBA Members David Watson, Jonathan Cooper, ZBA Alternates Gary

                        Stokes & Claude Walter

 

Absent:             James Hulen-In his absence Claude Walter represented his seat

CALL MEETING TO ORDER:

ZBA Chairman Clayton McGraw called the meeting of the Zoning Board of Adjustments and Appeals to order at 5:30 P.M..

 

 DISCUSSION/ACTION ZBA MEETING MINUTES OF AUGUST 22, 2006:

A motion was made by David Watson and seconded by Claude Walter to approve ZBA Minutes of August 22, 2006.  Motion carried, all voting aye.

 

 DISCUSSION/ACTION ZBA CASE NO. 060901:

A motion was made by Jonathan Cooper to permit this request for two years, Joel Sheffield recommended one year, Jonathan amended his motion to one year seconded by Joel Sheffield to approve the request by Brandi Leber for a Special Use Permit for property located at 1050 Gilmer Street, being further described as Lots 5 & 6, Block 204-1 to operate a drive thru tobacco shop.  Staff presented their recommendation and informed ZBA that the Planning and Zoning Commission recommended to deny the request at their meeting on Sept. 18, 2006. The Board addressed the fact that a Special Use Permit was issued to Higher Ground for a temporary building to be used as a drive thru coffee shop at this location and was concerned about making the same mistake twice. Traffic in the area was discussed.  Mike and Kara Petty along with Patrick Leber spoke in favor of this request.  The motion failed with three voting in favor, Joel Sheffield, Jonathan Cooper, David Watson and two voting in opposition, Clayton McGraw and Claude Walter. Motion failed.

 

 ANY OTHER BUSINESS:

No other business, Johnny made the Board aware of two agenda items for next month.
