MEETING MINUTES

AUGUST 22, 2006

CALL MEETING TO ORDER:

ZBA Chairman Clayton McGraw called the meeting of the Zoning Board of Adjustments and Appeals to order at 5:30 P.M..

DISCUSSION/ACTION ZBA MEETING MINUTES OF APRIL 18, 2006:

A motion was made by James Hulen and seconded by Gary Stokes to approve the ZBA Minutes of July 18, 2006.  Motion carried, all voting aye.

DISCUSSION/ACTION ZBA CASE NO. V060801:

A motion was made by Jonathan Cooper and seconded by Claude Walter to approve a request by Gary and Sally Sanvig for a variance for property located at 1321 Jefferson St. East, being further described as Lot 4, Block 303.  There were two issues at hand one being the expansion for non-conforming use and the other the fire separation between the residence and the business.  Staff does not have an issue with the non-conforming use, but would like the stipulation that the fire separation needed between the residence and business be enforced.  The motion states the Board will grant a variance for the structure as long as that structure (the porch portion) is torn off to comply with the fire code.  Motion carried, all voting aye.

ANY OTHER BUSINESS:

The Board was made aware of a Special Use Permit request for next month.

No other business before the Board, ZBA Chairman Clayton McGraw adjourned the meeting at 5:44 P.M..
